Intellectual Property and Notice Procedure for Infringement Claims

Unless specified otherwise, the Website and all content and materials on it—including, without limitation, all logos, designs, text, graphics, pictures, information, data, software, sound files and the arrangement thereof (collectively, the “Content”)—are the proprietary property of Merifund and are protected under Singapore’s Copyright Act 2021, trade‑mark legislation and other applicable intellectual‑property laws worldwide.

If you believe in good faith that any Content infringes your copyright or other intellectual‑property rights, please send a written notice to our Designated Representative at legal@merifund.com with the subject line “Notice of Alleged Infringement”. Your notice must:

Identify the work claimed to have been infringed (or, if multiple works are covered, provide a representative list of such works);
Identify the material that is claimed to be infringing and provide information reasonably sufficient to enable us to locate it (for example, a URL);
Provide your full name, postal address, telephone number and e‑mail address;
Include a statement that you have a bona fide belief that the disputed use is not authorised by the rights‑holder, its agent or the law; and
Include a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the rights alleged to be infringed.

We will process properly completed notices in accordance with applicable Singapore law and, where relevant, the EU Digital Services Act. Please note that you may be liable for damages (including costs and legal fees) if you knowingly make a material misrepresentation regarding infringement.

Governing Law, Severability and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non‑contractual disputes or claims) shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict‑of‑laws principles. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG), the Uniform Commercial Code, nor Incoterms.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Any controversy or claim arising out of or relating to these Terms, including the interpretation or breach thereof, shall be resolved exclusively in the courts of Singapore. You waive any objection to venue on the grounds that proceedings have been brought in an inconvenient forum.

Changes to These Terms of Service

We may revise these Terms from time to time. If we make material changes, we will post the updated Terms on this page and, where you have provided us with contact details, notify you by e‑mail at least thirty (30) days before the amendments come into effect. Your continued use of the Website after the effective date of the revised Terms constitutes your acceptance of the changes.
